CCMA — COMMISSION FOR CONCILIATION, MEDIATION AND ARBITRATION
Legal representation at the CCMA is limited and may not always be allowed by the Commissioner.
The conciliation process is a process whereby the commissioner will endeavour to get the parties to agree on an outcome. Legal representation is almost never allowed at the conciliation stage. In the event of the conciliation failing, the matter will then be referred to for Arbitration.
At the arbitration stage, the commissioner will listen to the evidence of both parties and then make an award. The arbitration is run in a similar manner to that of a trial. Legal representation is allowed at the arbitration stage subject to the following factors being taken into account:-
- the nature of the questions of the law raised by dispute;
- the complexity of the dispute;
- the public interest; and
- the comparative ability of the opposing parties, or their representatives, to deal with the arbitration of the dispute.
The Con-Arb process is a process whereby the Arbitration commences immediately after the Conciliation.
We provide legal advice on the proper steps to take and legal representation at the CCMA which includes arguing in favour of legal representation.
